In recent time India has witnessed a number of scam and economic offenses , which have left the adverse impact on the indian economy and also on the banking industry , which are unrecoverable. Often banking industry never accept but they play a huge role in this scam and also in this economic offenses . government refer them as the “loot and scoot” offender. These fugitive can run but they can’t hide from our law. This articles talks about the fugitive. They just run from to face the criminal trial. From cricket organizers, liquor barons to diamond merchandise all have accused are of multi corers scams and offenses and the interesting point is that our government took the numbers of years to pass this bill and take lots of time to punish them. If our system will continue like this ,then there will born a fugitive in every year.As the 2015 data produced by the national crime records bureau, the number of economics offences are double from the last decade. In the past, several laws has been enacted to regulate financial discipline and recovery of monies in case of delinquencies and irregularities. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;Parliament pass The Fugitive Offender Act, 2018. and this act was passed for the all individual who is, or becomes , a fugitive economic offender on or after date of coming into force of this act. This bill provide the measures for those fugitive economic offender from evading the process of law in India by staying outside the jurisdiction of India courts, to preserve the sanctity of the rule of law in India and for matters connected therewith or incidental thereto. There are more than 100 corers which are listed in the schedule of The Fugitive Economic Offender Act. After this court declared Vijya Maliya a fugitive economic offender. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;The purpose of this bill is largely to create compelling environment to all the fugitive, who defraud and indulging offences and abscond. So people who are absconded they need to brought back and create the compelling environment for the fugitive offender bill. Ultimately need to know that public is being to cheated by those offender and that person is going to benefit of this fraud, but public has no role taking initiative against that offender , only director and deputy director can take initiative for &nbsp;this proceeding. So by this means there is the affair between the government and the offender. If government want they can initiate proceed if they don’t want they will not proceed. Even there is no such provision in this also that if an individual is not able to take initiate against that absconded person, he can not petition to the government regarding bring him back. The deputy director or the director has thee full power to file the petition against him but he always wait for the application from people. They are already empowered, he is very powerful for example if the director issues the notice he has the power to attach the property of that offender, so the director is very powerful. In this bill there is 54 sections and 15 act under this. There is 100 crore criteria is given for the fugitive but if we read the fugitive offender act there is no such criteria like this so in my sense if the there is below of 100 crore they should also be punishable, they should also comes under the fugitive, because they are also hurting our economy. Hence the purpose of this bill is to catch the big fish but it does not mean that we left the small fish. If we check , then we will get number of the offences , so if we go below that criteria then most probably we will get number of culprit. Another point is that there is a provision that if a person come back means after he join the proceeding after absconding , then court may stop/ terminate the proceeding &nbsp;and that person will with the normal civil suit so the court have the discretionary power that court may or may not be stop the proceeding.Special court is empowered to attached the property for the 30 and also can continue that attachment for 180 days once the person is declared fugitive , after he abscond . even that property is in India or in abroad.once the person is abscond he will loose all his property and also his right from his property. Whenever that person come back India he will not get return his property and that property will be confiscated. So &nbsp;he will not to allow to participate in the proceeding relating to defending his property, that is big right of an individual that is sought to be withdrawn from an Indian citizen and it is very important significant of the law. Accused is also a human being and he has also a fundamental right to defend himself ,and just for achieving some goals we can’t compromise these right. India and abroad most probably is always in contract so the question is how India will attach the property from abroad? So the government has many treaty with the several country. And suppose there is such country who has no any treaty then India can impose his rules on that country. But if we see in past there is several country who don’t co-operate after the treaty. If we talks about the Benami property , then there is benami property is not in the name of the person that property can be on the name of his servant, onhis family member, on his son, on his wife , on his name of his manager and etc. So that is also attached and if that property is jointly with the three , four person that property would also confiscated by the government.&nbsp; &nbsp; &nbsp; &nbsp;
